The Abu Dhabi Family, Civil, and Administrative Claims Court dismissed a company's lawsuit demanding that a resigned employee pay it 40,000 dirhams in compensation for leaving work before the end of the contract period and refusing to hand over the equipment and documents in his custody, noting that the papers lacked evidence of the defendant's sponsorship transfer to the plaintiff.
In detail, a company filed a lawsuit against an employee, demanding that he pay it an amount of 20 thousand dirhams in compensation for the damage, as well as an amount of 20 thousand dirhams in exchange for his leaving work, as agreed upon, and that he pay expenses, fees, and attorney fees.
The corporation stated that it signed a one-year employment contract with the defendant and provided him with paperwork, documents, and equipment for his work. However, he left the country and left work without informing the plaintiff, and he did not give over the equipment, documents, and papers to her, causing her pain.
In addition to divulging the company's secrets and information despite having signed a pledge not to do so, and despite her request that he hand over what was in his custody and pay the agreed-upon amount if he left work, he did not react.
The court explained that the plaintiff filed her lawsuit because the defendant worked for her and violated the terms of the contract by leaving work without returning the documents and papers delivered to him, as well as the insurance amount estimated at 20,000 dirhams.
According to the Emirati company, the paperwork lacked any evidence that the employment contract had been implemented, as well as any indication that the defendant's sponsorship had been transferred to the plaintiff. They also lacked any evidence that the defendant had acquired the custody sought by the plaintiff. The papers also contained no indication that the defendant had left work.
He traveled outside of the country, according to the plaintiff's explanatory memorandum given to the case management office. As a result, the complaint was filed without merit, and the court ruled to dismiss it as is, with the plaintiff required to pay expenses and fees.
