Forgery of Contracts and Seizure of Funds:
The plaintiff outlines the case, stating that the defendant forged two contracts, one for a residential villa project and another for personal financing. The defendant successfully imitated the company’s seal, leading to the wrongful seizure of 396 thousand dirhams owned by the company. The criminal court found the defendant guilty despite facing criminal charges.
Civil Court Compensation Claim:
The plaintiff has taken legal action by bringing a claim for damages in civil court, representing both tangible and intangible losses. The defendant's criminal conviction, according to the complaint, proves that he is responsible for the confiscation of the cash.
Res Judicata Principle:
The court emphasises the legal principle of res judicata, asserting that the criminal ruling holds authority in the civil court and that re-examining responsibility is not permissible. The defendant's conviction in criminal court serves as a cornerstone, conclusively proving his fault in the matter.
Additional Damages and Emotional Distress:
The court acknowledges that the defendant's crime resulted in additional material damages, preventing the implementation of the agreed-upon villa construction project. The emotional toll on the complainant, including grief and heartbreak, is considered part of the compensation sought.
Court Ruling:
Based on the established criminal conviction and the consequential damages suffered by the complainant, the court rules in favour of the plaintiff. The defendant is obligated to pay the complainant an amount of 450 thousand dirhams in compensation.
