The Abu Dhabi Family, Civil, and Administrative Claims Court has delivered a favourable ruling in favour of a young man who sued a car dealer and a vehicle inspection centre, marking a significant court decision.
Contract Cancellation and Compensation Ruling
The court invalidated the vehicle sale agreement and ordered the vendor to pay back 62,000 dirhams to the purchaser. The plaintiff was also ordered to receive 1,500 dirhams as compensation from the vendor and the vehicle inspection centre.
Buyer's Lawsuit Details
The plaintiff's lawsuit detailed his demand for the annulment of the car sales contract, seeking joint liability from the defendants for the repayment of 62 thousand dirhams. This amount encompassed the car's value, registration, inspection, and insurance fees, coupled with a compensation claim of 1,500 dirhams. The buyer contended that the car, sold as accident-free, was later found to have concealed damages after an inspection at an approved center. Suspecting collusion between the seller and the inspection centre, the buyer initiated legal proceedings.
Expert's Report Validates Buyer's Claims
The court underscored the significance of the expert's report, which substantiated the presence of hidden defects in the car. Despite the defendant's absence in court, the expert's findings and the buyer's unchallenged claims led the court to rule in favour of contract annulment, restoring the parties to their pre-contract conditions. The first defendant, the car seller, was mandated to reimburse the plaintiff for the car's value.
Compensation for Faults and Errors
The court determined the defendant's fault and affirmed the expert's revelation of an error by the second defendant, the car inspection centre, during the initial inspection. Consequently, the second defendant, in solidarity with the first defendant, was held liable to compensate the plaintiff with the requested amount of 1,500 dirhams.
